Conditional Use Permit/Zoning Process

When: Certain land uses present potential nuisances to the adjoining properties. These land uses may be permitted in zoning districts under certain conditions. If the land use is shown

  1. Not to endanger the health, safety, or morals of a community, or
  2. Not to impede the orderly development of the area, the City of Markesan may grant a Conditional Use Permit.


A conditional use permit is required for certain land uses listed under each specific zoning district.


Process: 

  1. The Planning Commission may authorize the Building Inspector to issue a conditional use permit for conditional uses specified in the Zoning Ordinance after review and a Public Hearing, provided such uses are in accordance with the Zoning Ordinance. Conditional uses are granted by the Planning Commission if it finds that the proposed use is not detrimental to adjacent land because it is an inappropriate use, would create traffic hazards, would hinder future development in the area, would create undesirable levels of noise and light in the immediate area, and would cause property values to measurably decline.
  2. Applications for conditional use permits are submitted to the Building Inspector. A fee of $250.00 must be paid at the time of submittal. Such forms will be provided by the Building Inspector and must be accompanied by a plan showing the location, size and shape of the land involved and of any proposed structures, and the existing and proposed use of each structure and lot.
  3. The Planning Commission shall review the application, neighboring uses, parking areas, driveway locations, highway access, traffic generation and circulation, drainage, and the proposed operation.
  4. Conditions relating to but not limited to, landscaping, architectural design, type of construction, construction commencement and completion dates, hours of operation, traffic circulation or parking requirements, highway access restrictions, or increased lots may be required by the Planning Commission upon its finding that such conditions are necessary. If an operating element of a business can be shown to affect the health, safety or welfare of inhabitants of neighboring properties, the Planning Commission may exert such operational controls as may be necessary.
  5. Conditional uses shall comply with all provisions of the Zoning Ordinance such a lot width and area, yards, height, parking and unloading.
  6. Any development within 500 feet of the existing or proposed right of way of any freeway, expressway or other controlled access trafficway, and within 1,500 feet of their existing or proposed interchange or turning land right of way shall require the issuance of a conditional use permit.
